Returns Policy
of the BONDLY LASHES online store
1. General provisions
- This Returns Policy sets out the rules for withdrawal from a distance contract, meaning the return of goods, by customers of the Bondly Lashes online store operating at: https://www.bondlylashes.com.
- The seller and store administrator is:
Bondly Lashes sp. z o.o.
ul. Płatowcowa 22, 94-223 Łódź, Poland
KRS: 0001201602, NIP: 7272894015, REGON: 54305921100000
e-mail: bondly@bondlylashes.com - The rules described in this Returns Policy supplement the provisions of the Bondly Lashes online store Terms and Conditions. In the event of any inconsistency, the provisions of the Terms and Conditions shall prevail, subject to applicable law.
2. Who can exercise the right of return?
- The right to withdraw from the contract, meaning to return goods without giving any reason, is available to:
• Consumers – natural persons making a purchase not directly related to their business or professional activity,
• Entrepreneurs with consumer rights – natural persons entering into a contract directly related to their business activity, where the contract is not of a professional nature for them within the meaning of the Consumer Rights Act.
- For simplicity, this Returns Policy refers to these persons collectively as “Privileged Buyers.”
- Entrepreneurs making purchases strictly for business or professional purposes, meaning typical B2B transactions, do not, as a rule, have a statutory right to withdraw from the contract. Any returns in such cases may be considered only individually, based on arrangements made with the Seller.
3. Time limit for withdrawal from the contract
- A Privileged Buyer has the right to withdraw from a distance contract, meaning return goods without giving any reason, within 14 days.
- The 14-day period is calculated from the day:
• on which the Buyer, or a third party indicated by the Buyer other than the carrier, received the goods, or
• in the case of an order consisting of multiple items delivered separately, from the day the last item was received.
- To meet the deadline, it is sufficient for the Privileged Buyer to, before it expires:
• send the Seller a statement of withdrawal from the contract, for example by e-mail, or
• dispatch the return parcel and be able to document it, for example with proof of posting.
4. How to notify a return
- To exercise the right of return, the Privileged Buyer should submit a statement of withdrawal from the contract.
- The statement may be:
• sent by e-mail to: bondly@bondlylashes.com,
• sent by post to the registered office address:
Bondly Lashes sp. z o.o.
ul. Płatowcowa 22
94-223 Łódź
- The Buyer may use the model withdrawal form available in the Store Terms and Conditions, Annex No. 1, but this is not mandatory. A clearly written statement of withdrawal is sufficient.
- To help process the return efficiently, it is recommended that the statement includes:
• the order number,
• full name,
• the e-mail address used for the order,
• the type of returned product.
5. Where and how to send the returned goods
- The returned product should be sent to:
Bondly Lashes sp. z o.o.
ul. Płatowcowa 22
94-223 Łódź, Poland
- The goods should be returned without undue delay, no later than within 14 days from the day the Seller was informed of the withdrawal from the contract.
- The deadline is met if the Privileged Buyer sends the goods before the 14-day period expires.
- Recommendations, these are not conditions for accepting the return, but they help ensure smooth processing:
• protect the goods against mechanical damage during transport, for example using packaging, filler, or protective foil,
• where possible, include the receipt, invoice, or a printout of the order confirmation,
• include contact details and information that this is a return parcel.
6. Who bears the return shipping costs
- In the case of withdrawal from a distance contract, the Privileged Buyer bears the direct costs of returning the goods to the Seller, meaning the return shipping costs.
- The Buyer may choose any shipping method, for example postal service, courier, parcel locker, and so on. The Seller does not accept cash-on-delivery return parcels unless the parties agree otherwise.
7. What the Seller refunds and within what time
- After effective withdrawal from the contract, the Seller refunds the Privileged Buyer:
• the price of the purchased product,
• the delivery cost to the Buyer, up to the amount of the cheapest standard delivery method offered in the store for that order.
- If the Buyer selected a more expensive delivery method, for example express delivery, the Seller is not obliged to refund the difference between that method and the cheapest offered option.
- The refund shall be made no later than within 14 days from the day on which the Seller was informed of the Buyer’s decision to withdraw from the contract.
- The Seller may withhold the refund until:
• it has received the returned goods, or
• it has received proof from the Buyer that the goods were sent back,
whichever occurs first.
- The refund shall, as a rule, be made using the same payment method used by the Buyer for the original transaction, unless the Buyer expressly agrees to another method that does not involve any additional cost for the Buyer.
- In the case of payment by card, the refund shall be made to the account linked to that card.
8. Condition of the returned goods and liability for diminished value
- The Privileged Buyer has the right to inspect the product to the extent that would be possible in a physical store, for example to examine the packaging and assess the length, thickness, and visual effect of the lashes, without fully using them over a longer period.
- The Buyer is liable for any reduction in the value of the goods resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the product.
- If the returned product shows signs of excessive use, for example visible wear, damage, missing elements of the set, or stained or destroyed packaging significantly reducing its commercial value, the Seller has the right to reduce the refund amount proportionally to the extent of the loss in value.
- The Seller shall assess the condition of each returned product individually, with due respect for the Buyer’s rights.
9. Returns of digital content, e-books, access to the VIP zone
- Special rules apply to the purchase of digital content not supplied on a tangible medium, for example an e-book, access to the VIP zone, or online materials.
- Before completing the purchase of digital content, the Privileged Buyer is asked to tick a separate checkbox with wording similar to:
“I agree to the supply of digital content before the expiry of 14 days from the conclusion of the contract and acknowledge that once performance has begun, I lose the right to withdraw from the contract.”
- If:
• the Buyer ticks the above checkbox, and
• the Seller begins performance, for example by providing a download link for the e-book or access to the VIP zone or online materials,
then the Buyer loses the right to withdraw from the contract concerning that digital content.
- If the Buyer does not give the consent referred to above, the digital content will only be made available after 14 days have passed, or the right to withdraw from the contract will remain in effect during that period, in accordance with the Consumer Rights Act.
10. Returns in the case of business purchases, B2B
- In the case of Buyers who are not Privileged Buyers, meaning typical entrepreneurs making purchases directly related to their business or professional activity, the provisions regarding the consumer right to withdraw from the contract do not generally apply.
- The Seller may, in individual cases, consider a request for return or exchange of goods. This, however, is a discretionary decision and does not arise from the Consumer Rights Act.
- If the Buyer wishes to make a return in a business context, they should contact the Seller by e-mail in order to discuss possible solutions.
11. Final provisions
- This Returns Policy is not intended to exclude or limit any rights of a Privileged Buyer arising from mandatory provisions of law, in particular the Consumer Rights Act.
- In matters not regulated by this Returns Policy, the provisions of the Bondly Lashes online store Terms and Conditions and the applicable provisions of Polish law shall apply.
- The Seller may make changes to this Returns Policy for important reasons, for example changes in the law, delivery methods, or payment methods. The amended Returns Policy shall apply to contracts concluded after the date of its publication on the Store website.
